iRide Limited Liability Policy

This Limited Liability Policy ("Policy") outlines the scope of iRide's liability as a platform connecting riders with drivers. By using iRide's car-hailing services, all parties (drivers and riders) acknowledge and agree to the following terms:

1. General Scope of Liability

1.1 Platform Role:

iRide is a technology platform that facilitates connections between drivers and riders. iRidedoes not own, operate, or control any vehicles and is not responsible for the actions of drivers or riders.

1.2 Service Facilitation Only:

iRide provides a platform to book rides but does not guarantee availability, punctuality, or quality of service.

2. Liability Regarding Drivers

2.1 Driver Conduct:

Drivers using the iRide platform are independent contractors, not employees of iRide. iRide is not liable for:

• Driver conduct or behavior during the ride.
• Any illegal, negligent, or reckless actions taken by the driver.
• Delays, cancellations, or ride refusal by drivers.

2.2 Driver Screening:

iRide conducts a basic screening process for drivers but cannot guarantee the accuracy or completeness of driver-provided information. Riders are encouraged to report any concerns for review.

3. Liability Regarding Riders

3.1 Rider Conduct:

Riders are responsible for their behavior during the ride. iRide is not liable for:

• Damage caused to the driver's vehicle or property by the rider.
• Harassment, misconduct, or illegal actions by riders.

3.2 Rider-Driver Disputes:

Any disputes between riders and drivers must be resolved independently. iRide may mediate disputes at its discretion but is not obligated to provide resolution.

4. Liability for Vehicle Safety

4.1 Vehicle Maintenance:

Drivers are solely responsible for the maintenance and safety of their vehicles. iRide is not liable for:

• Mechanical issues, malfunctions, or breakdowns during rides.
• Accidents caused by vehicle defects.

4.2 Roadworthiness:

iRide does not inspect vehicles and cannot guarantee their roadworthiness or compliance with local laws.

5. Liability for Payments

5.1 Cash Payments:

For cash payments, iRide is not responsible for:

• Non-payment by riders.
• Discrepancies or disputes between riders and drivers regarding the amount due.

5.2 Electronic Payments:

For electronic payments:

• iRide does not process payments directly and is not responsible for delays, errors, or disputes in fund transfers.
• Users are responsible for completing payment transactions independently.

6. Liability for Location Tracking

6.1 Location Data:

iRide uses real-time location tracking to facilitate services but is not liable for:

• Accuracy of location data.
• Disruptions in GPS services caused by external factors (e.g., poor signal, technical issues).

7. Liability in Case of Accidents or Incidents

7.1 Personal Injury or Property Damage:

iRide is not liable for injuries, losses, or property damage arising from:

• Accidents during rides.
• Physical altercations or confrontations between riders and drivers.

7.2 Insurance Coverage:

Drivers are required to maintain personal vehicle insurance that complies with local laws. iRide does not provide insurance coverage for vehicles, drivers, or riders unless explicitly stated.

7.3 Emergency Situations:

In case of emergencies, riders and drivers are encouraged to contact local authorities. iRidemay assist in providing contact details but assumes no responsibility for incident resolution.

8. Liability for Service Interruptions

iRide is not liable for service interruptions caused by:

• Technical issues with the app or platform.
• Network outages or poor connectivity.
• Unforeseen events, such as natural disasters or strikes.

9. Data Privacy and Security

9.1 User Data Protection:

iRide is committed to protecting user data in compliance with privacy laws but is not liable for:

• Unauthorized access to user accounts due to user negligence (e.g., weak passwords).
• Data breaches caused by third-party cyberattacks.

10. Indemnification

Users (both riders and drivers) agree to indemnify and hold harmless iRide from any claims, damages, or losses arising from:

• Non-compliance with this Policy.
• Violations of local laws or regulations.
• Misuse of the iRide platform.

11. Force Majeure

iRide is not liable for delays, interruptions, or failures to provide services due to events beyond its reasonable control, including but not limited to:

• Acts of God.
• Government actions or regulations.
• Technical failures or cyberattacks.

12. Governing Law and Jurisdiction

This Policy is governed by the laws of Pakistan. Any disputes arising from this Policy shall be resolved exclusively in the courts of Lahore, Pakistan.
